TRANSACTION ACCEPTANCE POLICY:

Simply Sellular will pay full value if the handset(s) sent are in acceptable condition as outlined below. If you select Paypal as your method of payment, we will issue payment within 1 business day from the time that the handset clears our testing and verification process. The shipment or sale to Simply Sellular of your handset(s) confirms your acceptance of our price and condition offer.

CONDITION OF HANDSET(S):

Simply Sellular pays for phones based on the following scale:

Excellent condition (100 percent): Phone is in excellent or better cosmetic condition. Phone is fully functional (powers on, makes and receives calls, has no water damage) and has very few, if any, cosmetic flaws. Any flaws that it does have are not noticeable.

Good condition (75 percent): Phone is in good cosmetic condition. Phone is functional (powers on, makes and receives calls, has no water damage) and has signs of wear and tear.

Fair condition (50 percent): Phone is in fair cosmetic condition. Phone is functional (powers on, makes and receives calls, has no water damage) but shows significant signs of use, including wear, scuffs, and scratches.

Poor condition (0 percent): Phone is in poor cosmetic condition. Phone is fully functional (powers on, makes and receives calls, has no water damage) but shows heavy signs of use, including heavy scratches, dents, or blemishes.

Broken condition (0 percent): Phone is not fully functional. Problems include, but are not limited to: does not power on, does not make/receive calls, camera doesn't work, phone cannot be activated, cracked or broken display, cracked case, water damage

All handsets must be in working order to qualify for payment. They must power-up and make a test call. They will not be crushed, water damaged or have broken LCD's. Cases should be complete and unbroken. All original manufacturer parts, including antennas, must be present on the handset. All handset(s) shall have a valid ESN or IMEI number and a working battery. The handset must not have an active account with any wireless service provider. All features of the handset, including but not limited to cameras, microphones, and speakers, must function. Cosmetic factors affecting the resale value of the phone, such as but not limited to significant wear or scratching of the handset, or pieces that are glued to the phone, may affect Simply Sellular's purchase price of the phone. Any handset(s) sent in other than those listed on the initial transaction will not be returned and will become the property of Simply Sellular. These units will be recycled or donated to our 911 phone program. Please verify the accuracy of your transaction before submitting for approval. Handsets that have service with Verizon or any CDMA carrier must be deactivated. Handsets must not be reported lost or stolen. Simply Sellular DOES NOT BUY HANDSETS THAT HAVE SERVICE WITH SPRINT, US CELLULAR, METRO PCS, CRICKET WIRELESS, ALLTEL, AMPD MOBILE, VIRGIN MOBILE, QWEST COMMUNICATIONS, TRACFONE, NTELOS, MIDWEST WIRELESS, CINCINNATI BELL WIRELESS, BLUEGRASS,SIMPLE FREEDOM, SMART TALK, CELLCOM,CBEYOND, BOOST UNLIMITED, CREDO, CELLULAR SOUTH, UNICEL, ELEMENT, COMMON CENTS, COX WIRELESS, CONSUMER CELLULAR, APPALACHIAN WIRELESS, I-WIRELESS ANY PREPAID CELLULAR SERVICE, ANY CELLULAR COMPANY THAT NO LONGER OFFERS SERVICE, ANY NON-DOMESTIC INTERNATIONAL CARRIER, any iDen carrier, including but not limited to Boost, Nextel, and Boost Unlimited, and any other carrier that is not for service with AT&T, T-Mobile, Verizon, Sp. Handsets that have an account with Verizon, AT&T and T-Mobile must be deactivated, able to be activated by someone else, and have no remaining outstanding balance on the account. Handsets that have been flashed, rooted, or otherwise modified beyond normal software updates are not eligible for payment. Handset(s) sent to Simply Sellular not accompanied by an order slip identifying the order number of the handset(s) automatically become property of Simply Sellular. If you wish to change your transaction simply contact customer service online.

PROBLEMS WITH ORDER:

If the handset returned is not the handset listed on the original transaction and the phone is listed in our database on the day of receipt of the phone, Simply Sellular will pay the price in our database on that day for the actual phone received. If the phone is not listed in our database, if the handset is damaged, if the handset is broken, or if the handset has significant cosmetic problems affecting its resale value, Simply Sellular will make an adjusted trade offer to the user via email. If the handset is missing a back, battery, or any other part, payment for the handset may be delayed up to a month. For handsets that function correctly and are in good cosmetic condition, Simply Sellular will pay the full listed price for the handset. Simply Sellular may make an offer for 75, 50, 25, or 0 percent of the original value of the handset based on the handset's condition and its resale value. Phones that are extremely worn, even if functional, will not be paid for. The offer will be sent via email to the email address provided by the user at the time the order is placed. If the adjusted offer is not acceptable, Simply Sellular will return the shipment at a cost of $10 per phone. Phone will be held a maximum of 30 days from date of adjusted offer. If the adjusted offer is accepted the adjusted payment will be made based on the date of receipt of the handset. Simply Sellular will not be responsible for user delays. User must respond, via email, to support@simplysellular.com to any adjusted trade offer within two business days or Simply Sellular will assume the adjusted offer is acceptable and process the shipment using the adjusted offer. Simply Sellular cannot guarantee that the exact phone will be returned to the user, only that a phone of the same model. After 90 days from the original submission of an order Simply Sellular will consider the order void.

CELL PHONE SERVICE:

It is the user's responsibility to discontinue service on handsets sold to Simply Sellular before shipping the phone. Simply Sellular is not responsible for previous or subsequent airtime charges accrued prior, during, or after any transaction. Should any airtime charges be accrued, it is the responsibility of the original user and service provider to resolve payment issues.

SHIPMENT OF PHONES:

Simply Sellular is not responsible for phones that are lost or damaged in transit. If the user wishes, it is the user's responsibility to insure the phone or provide delivery confirmation when the user ships the handset to Simply Sellular. If a phone is not able to be located, it is the user's responsibility to provide the ESN or IMEI number of the phone so that it can be located. All ESN or IMEI numbers of phones that are sent to Simply Sellular are recorded. Once you ship the phone to Simply Sellular, you reliquish all ownership rights to the phone. You agree that in order for Simply Sellular to return the phone to you for any reason, a $10 return shipment fee will apply

SUBSCRIBER INFORMATION:

If desired, it is the responsibility of the user to remove any and all personal information from all phone memory and removable memory including but not limited to, phonebook entries, personal codes, e-mail addresses, personal addresses, IM addresses, photos, and downloaded files. Any personal information including but not limited to the aforementioned data could be used in a negative manner and it is the sole responsibility of the user to clear all information that could be harmful to the user if made public.

OWNERSHIP AND CONDITION OF PHONE:

By filling out an order to ship us a handset and sending us the handset, you certify that you are the rightful legal owner of the handset. You agree that all iCloud, Samsung, Google and any other relevant locks that may be on the phone are removed. You certify that the phone is in the cosmetic and functional condition noted on your order, and that the phone is not blacklisted, financed, leased, lost, stolen, or otherwise unable to be activated with the stated carrier. You certify that the phone is in full working condition and all functions of the phone work, as a new phone would, including Siri, camera, wifi, bluetooth, and any and all other functions of the phone.

PAYMENT:

In most cases, payment will be sent approximately 10 days after it is deemed that the phone will be paid for. If there is a dispute in condition users will be notified by e-mail with an adjusted offer. If the adjusted offer is not acceptable, Simply Sellular will return the shipment at the users expense. If the adjusted offer is accepted the adjusted payment will be made based on the date of the original trade. Simply Sellular will not be responsible for user delays. User must respond to any adjusted trade offer within two business days or Simply Sellular will assume the adjusted offer is acceptable and process the shipment using the adjusted offer. If payment for phones has to be reissued for any reason, there will be a $20 check reissue fee.

LEGAL COMPLIANCE:

Simply Sellular does not accept phones from minors. You must be 18 years of age or older to utilize our service. Simply Sellular does not accept stolen or lost phones. It is the responsibility of the user to make sure that the phone is not reported lost or stolen, and any legal issues resulting from such phones are solely the responsibility of the user.

PRICING:

All pricing is subject to change without notice. Simply Sellular reserves the right to void any transaction and return the phone to the user at the user's cost for a $10 fee.
